Terms and Conditions of Use
By booking, entering, or using the Broadway Rooftop Pickleball facility, you agree to be bound by these Terms and Conditions. These Terms apply to all users, players, spectators, visitors, and participants.
Authorised Access
A valid booking is required to enter and use the facility.
Unauthorised access or use of courts is strictly prohibited.
Access codes are issued for personal use only and must not be shared.
The booking holder is responsible for all persons accessing the facility under their booking.
Unstaffed Facility
This is an unstaffed venue.
No supervisors, staff, or first aid personnel are present on site.
You are solely responsible for your own safety and the safety of others in your group.
In the event of an emergency, call 000 immediately.
Acknowledgement of Risk
Participation in physical activity involves inherent risks.
Risks include slips, trips, falls, collisions, uneven surfaces, weather exposure, equipment failure, illness, property damage, and contact with barriers or divider nets.
Serious injury or death may occur.
By using the facility, you acknowledge and accept all inherent risks.
Assumption of Responsibility
You participate at your own risk.
You are responsible for your own actions, behaviour, and safety.
You are liable for any injury, damage, or loss caused by your actions or omissions.
Weather, Wind and Rooftop Conditions
As a rooftop venue, weather conditions may change rapidly.
Rain, wind, heat, or other environmental factors may create unsafe playing conditions.
Loose items must be secured at all times.
Do not play in wet or slippery conditions.
Stop play immediately if conditions become unsafe.
Management reserves the right to suspend or cancel play due to safety risks.
Refunds or credits may be issued for bookings affected by unsafe weather conditions.
Court Safety
Court layouts, run-off areas, and boundaries vary.
Divider nets and barriers may be in place.
Remain aware of your surroundings at all times.
Exercise caution near court edges, fencing, and dividers.
You accept the inherent risks associated with sporting environments.
Booking Time Compliance
Facility access is strictly limited to the booked session time.
Early entry or remaining on court after your booking ends is prohibited.
Overstaying may result in additional charges, suspension of access, or future booking restrictions.
Age Requirements
Participants must be 16 years or older unless part of an approved junior program.
Children under 16 must be supervised by a parent or legal guardian at all times.
Health and Medical Responsibilities
You confirm that you are physically and medically fit to participate.
Seek medical advice before participating if you have any health conditions or concerns.
Footwear and Equipment Safety
Appropriate sports footwear must be worn at all times.
Do not use damaged or unsafe equipment.
Report hazards or unsafe conditions as soon as practicable.
Return all balls and equipment to designated storage areas after use.
Alcohol, Drugs and Behaviour
Alcohol, illegal drugs, and intoxication are strictly prohibited.
Unsafe, aggressive, abusive, or disruptive behaviour is not permitted.
Users must respect other players, spectators, and neighbouring properties.
Breaches may result in immediate removal without refund.
Noise and Neighbour Amenity
Excessive noise, shouting, music, or disruptive conduct is not permitted.
Users must be mindful of neighbouring residences and shared building occupants.
Failure to comply may result in suspension or termination of access.
No amplified music to be played unless approved by management.
Prohibited Items and Activities
No glass containers.
No smoking or vaping.
No external coaching, lessons, or commercial activity without written approval.
No drones, tripods, or personal filming equipment without consent.
Do not move or alter court structures, fencing, or fixtures.
Damage, Cleaning and Property Care
Users are responsible for any damage caused to courts, fencing, nets, or equipment.
Excessive mess or damage may result in cleaning or repair costs charged to the booking holder.
The facility is not responsible for lost, stolen, or damaged personal property.
Insurance
The facility does not provide personal accident or injury insurance.
Users are responsible for arranging their own insurance coverage if required.
Release of Liability
To the maximum extent permitted by law, you release Play Pickle SSMG Operations Pty Ltd, its directors, officers, employees, contractors, and agents from all liability for injury, loss, damage, or expense arising from use of the facility or participation in any activity, except where liability cannot be excluded by law.
Marketing, Photography and Filming Consent
The facility may be photographed or filmed for marketing, promotional, operational, or security purposes.
By entering the facility, you consent to being photographed, filmed, or recorded, including audio and video.
You grant Play Pickle SSMG Operations Pty Ltd a perpetual, royalty-free right to use such material for lawful purposes without compensation.
Requests to opt out must be submitted in writing prior to booking.
Management will take reasonable steps to accommodate requests but cannot guarantee exclusion from incidental footage.
CCTV Monitoring
The facility is monitored by closed-circuit television.
Entry constitutes consent to CCTV recording for safety and security purposes.
Automated External Defibrillator and First-Aid
An Automated External Defibrillator is available within Broadway Shopping Centre (Located on level 3 adjacent to the bathroom and kids play area).
Users should familiarise themselves with the AED location prior to play.
There is a first-aid kit located at the equipment storage box.
Suspension or Termination of Access
Management may suspend or terminate access for breaches of these Terms, unsafe conduct, or misuse of the facility.
No refunds will be issued where access is revoked due to user behaviour.
Force Majeure
Access may be restricted or cancelled due to events beyond reasonable control, including severe weather, power outages, building restrictions, emergencies, or directions from the building owner or authorities.
Variation of Terms
These Terms may be updated from time to time.
The version in effect at the time of booking applies.
Continued use of the facility constitutes acceptance of the current Terms.
